Introduction

Welcome to the ALEXIA FINE JEWELRY website (hereinafter: “the Website”), an online store for the sale of jewelry (hereinafter: “the Products”), offered to internet users through a secure purchasing system, all subject to and in accordance with the following Terms and Conditions.
The Website is operated and managed by ALEXIA FINE JEWELRY (hereinafter: “the Company”). Any use of the masculine form in this document and/or on the Website also refers to the feminine, and vice versa.
For the purposes of these Terms:
Any use of the Website constitutes acceptance of these Terms and Conditions and the restrictions contained therein.
These Terms may change from time to time, and users must review the Terms each time they access the Website. Browsing or using the Website in any form constitutes agreement to the Terms and an obligation to comply with them. These Terms are a legally binding agreement in every respect and bind the user for any use of the Website.
“Privacy Protection Law” – Privacy Protection Law, 1981.

1. General Terms of Use

a. These Terms and Conditions are legally and contractually binding and apply to any use of the Website by a customer, as well as to any dispute that may arise between the customer and the Company. Therefore, it is recommended to read these Terms carefully in full.
b. It is strictly prohibited to provide false, incorrect, misleading, or defamatory information (including personal information) when using the Website. Providing such information may constitute a criminal offense and result in legal action against the customer, including for potential damage to the Company, its management, shareholders, or representatives.
c. Providing incorrect information entitles the Company to cancel the customer’s order immediately.
d. The transfer of a personal account on the Website to a third party without prior written approval from the Company is strictly prohibited.

2. Purchase Process and Conditions on the Website

a. Product purchases on the Website are only permitted for customers who meet the following criteria:
• The buyer is an adult over the age of 18 with full legal capacity.
• Holds a valid credit card from one of the following companies: Visa, MasterCard, or Diners.
b. The Company reserves the exclusive right to terminate a customer’s use of the Website at any time and at its sole discretion, for any reason, even if the customer has previously used the services. This includes, but is not limited to, the following cases:
• Providing incorrect or misleading information by the customer.
• Violation of the Terms outlined herein or in other agreements concerning the Company’s online services.
• Use of the Website’s services for illegal activities under Israeli law or to facilitate such acts.
• The existence of an outstanding debt by the customer to the Company or affiliated entities.
• The digital records of the Website, including data entered by the customer, shall serve as conclusive and binding evidence of actions taken on the Website.
c. Product purchases on the Website are intended for personal use only and not for wholesale purchase or resale to third parties.
d. All prices on the Website include VAT unless otherwise stated.
e. The Website management may update prices from time to time without prior notice.

4. Data Security and Privacy

• The Website management, as well as affiliated companies and subcontractors acting on its behalf to the same standards, may use the information provided in the form to deliver requested information and services. This personal data will not be disclosed or used for marketing purposes without explicit consent and will not be transferred to third parties without the customer’s express permission.
• The content of services and disclosure of personal information during the service will never be shared with any third party without written consent from the customer. The Website management is committed to protecting your privacy, which is a top priority.
• The Company undertakes to use the information provided by buyers solely for the purpose of enabling purchases on the sales Website and in accordance with applicable laws. The Company may send promotional information only if prior consent has been given.
• The Website is secured using advanced security measures designed to ensure proper operation and safe browsing, as well as to protect users’ privacy. All users commit not to perform any action that could disrupt Website activity, steal user data, or breach its security mechanisms.
• In cases of misuse, the Website management will take all legal measures available, including blocking the user’s access and pursuing legal action.
• By submitting details and making a purchase, the customer releases the Company from any liability for damages caused by data breaches, hacking attempts, or cyberattacks and waives any claims against the Company in this regard.
• Payments on the Website are secured using SSL protocol and comply with the highest security standards.
• The Website uses cookies to improve the user experience and personalize content.
• Users may delete or block cookies via browser settings, though some Website features may not function properly as a result.

5. Acceptance of Terms on the Checkout Page

• A checkbox confirming agreement to the Terms will appear on the payment page.
• It is not possible to complete the purchase process without checking this box. A link to view the full Terms will be provided prior to agreement.

6. Purchase Process on the Website

• During the purchasing process, the customer will be asked to enter: full name, phone number, city, postal code, email address, and payment details. There will also be an option to enter different billing information.
• The data provided when placing an order will be used solely for completing the order and related actions such as charging and issuing receipts. This information will not be shared with third parties, except as needed to complete the transaction (e.g., with credit card companies).
• Once the transaction is confirmed by the credit card company, an order confirmation including a tracking number will be sent to the email address provided by the customer.

7. Payment and Product Delivery Policy

a. The purchase process is completed only after receiving approval from the payment processor.
b. Product shipping will occur only after transaction approval. If approval is not received within five business days, the Company may cancel the order unilaterally without any liability.
c. Delivery methods – customers may choose self-pickup or delivery by courier.
d. Orders will be shipped within 21 business days from payment approval. Custom orders may vary and customers will receive email updates.
e. The Company is not responsible for delays caused by factors beyond its control such as force majeure, strikes, or technical delivery issues.

8. Product Warranty Policy

a. All products sold on the Website are new, packaged in original packaging, and covered by standard warranties in accordance with applicable law.
b. In cases where a gemstone or diamond (up to 5 points) falls out, the Company will replace it free of charge, up to two times per product, within three months of receiving the item.
c. The Company is not responsible for loss of center stones over 5 points.
d. All products are handmade to order, and therefore the final item may differ from the Website image in shape, color, size, weight, or design.
e. Upon prior coordination, customers may send jewelry up to twice a year for free professional cleaning. Coordination must be made via email or phone.
f. The Company’s total liability, whether contractual or otherwise, shall not exceed the amount actually paid by the customer for the product.

9. Order Cancellation Terms

a. Order cancellation and product return policy is subject to the Consumer Protection Regulations (Cancellation), 2010 and the Consumer Protection Law, 1981.
b. Orders for personalized products made to the customer’s specifications and/or modified products (including rings with custom gemstones or diamonds) cannot be canceled.
c. An order can be canceled within 24 hours of being placed, provided it has not been shipped.
d. A customer may cancel non-personalized product purchases within 14 days of receipt. Customers with disabilities, senior citizens, or new immigrants (as defined by law) may cancel within four months, subject to the provisions of Section 14C1 of the law.
e. Cancellation notice must be sent to the Company by phone, registered mail, or email (as listed on the Website) with confirmation of receipt.
f. Upon receiving a valid cancellation notice and confirming the order meets cancellation conditions, and provided the order hasn’t been shipped, the Company will refund the customer within 14 days. A cancellation fee of up to 5% of the order value or ₪100 (whichever is lower) may apply.
g. If the customer has already received the product, it must be returned in its original packaging and at the customer’s expense, according to the Company’s instructions. The Company is not liable for damage or loss during return shipping. If the item is found damaged (as determined solely by the Company), the customer will either receive the item back or may agree to pay for repairs before returning it to original condition.
h. If cancellation results from a defect, mismatch, or breach by the Company, no cancellation fees or return shipping charges will apply (subject to item return and defect confirmation).
i. The Company reserves the right to modify or cancel an order with prior notice to the customer. In such cases, no charges will apply, or charges will be based on the updated order if accepted by the customer.

10. Eligibility for Exchanges and Returns

Product exchange is permitted within 7 business days of receipt, subject to the following conditions:
a. The product was returned in its original condition with no defects or modifications (including gemstone or diamond replacement).
b. The product is returned in its original packaging without signs of use.
c. The product has not been used.
d. The warranty certificate is returned with the product.
e. The original purchase invoice is included with the returned item.
f. Customers wishing to exchange a product must contact the Company’s orders department via the email listed on the Website and receive a return authorization. The exchange will be processed only after inspection. Shipping costs are the customer’s responsibility.
g. Only one exchange is allowed per item.
h. Customized items (including resized or modified jewelry) are non-returnable.
i. Returns are not permitted for:
  1. Products made to custom measurements or specifications.
  2. Products that cannot legally be returned.
  3. Custom engagement rings with a selected center stone.
j. In all returns or cancellations, the customer is responsible for associated costs, including packaging, shipping, insurance, and return handling.
k. The Company is not responsible for any loss or damage during return shipping.

11. Custom Jewelry

a. Custom-made jewelry is non-returnable, non-exchangeable, and not eligible for cancellation.
b. Engagement or diamond/gemstone rings with a selected center stone are considered personalized and cannot be returned or exchanged.
c. Personalized necklaces (e.g., with initials) are made to order and non-returnable.
d. Rings ordered in size above 60 may be subject to price adjustments due to required design modifications.
e. Increasing a ring size by more than two sizes will incur an additional charge due to added materials and labor.
f. Note: Over time, engraved text may fade and blackened engravings may change in appearance.

12. Shipping Policy

a. Shipping fees are determined by the Company and may be listed on the Website or provided directly to the customer.
b. Since each item is made to order, estimated delivery time is 21 business days from production.
c. Custom-made items have individual timelines, which will be communicated to customers via email.
d. For orders with multiple items and different delivery times, customers may choose to ship all items together. This must be specified during checkout.
e. The Company strives to meet delivery timelines but is not responsible for delays caused by external factors like courier services. For issues, contact customer support.
f. For security reasons, shipping addresses cannot be changed after dispatch.
g. The Company is responsible for hand-delivered shipments via courier and only when coordinated with the delivery company. If the customer opts for delivery without signature or is unavailable at the agreed time, responsibility for loss or theft lies solely with the customer. If redelivery is required due to missed delivery, an additional fee will apply.

13. Errors and Inaccuracies

The Website may occasionally include typographical errors, inaccuracies, or omissions regarding product details, pricing, promotions, or stock availability. The Company reserves the right to correct such errors and update or cancel orders based on incorrect information at any time, even after an order has been placed, without prior notice.

14. Intellectual Property and Trade Secrets

• All intellectual property rights on this Website, including copyrights, distribution rights, trade secrets, trademarks, and any other IP rights relating to product design or Website content, are the exclusive property of the Company.
• It is prohibited to copy, reproduce, distribute, publish, or use any Website content or product images in any way without prior written permission from the Website management.

15. Governing Law and Jurisdiction

Any dispute related to Website use, product purchases, services received through the Website, or interpretation of these Terms will be governed solely by the laws of the State of Israel. Legal proceedings shall be conducted exclusively in the competent courts of Tel Aviv, excluding the application of foreign laws or jurisdictions.
